USCIS Announced Flexibilities for Certain Foreign Students Affected by Delayed Receipt Notices

On February 26, 2021, USCIS announced flexibilities for certain foreign students affected by delayed receipt notices for Form I-765 (OPT and STEM OPT). These special considerations apply only to applications received by USCIS on or after Oct. 1, 2020, through May 1, 2021.

The special considerations pertain to:

  • 14-Month OPT Period Rule Affecting Possible OPT End Dates
  • Refiling Following a Rejection
  • Missing or Deficient Signatures

USCIS Receipt Delays

There has been a national delay in USCIS issuing receipt notices for OPT and STEM OPT applications. This is now a known, national issue and several professional organizations are advocating for USCIS to issue the receipts.

Our office is unable to inquire on specific cases; this is under the jurisdiction of USCIS. 

The Office of the Citizenship and Immigration Services (CIS) Ombudsman is liaising with USCIS to address the issue. At this time, it is simply a matter of waiting for USCIS to issue receipts for submitted OPT/STEM OPT applications.

Applicants who have not received a receipt notice within 60 days of filing should first contact USCIS. If USCIS does not respond to your inquiry within 30 days, you may submit a request for case assistance to the CIS Ombudsman (https://www.dhs.gov/case-assistance).
